General Conditions Rebalancing School

Article 1: Definitions
In these General Terms and Conditions, the following terms are used, to which the following meaning is assigned (and whereby the definitions used are used both in the singular and in the plural).
Participant: a participant or student in an activity offered by the Rebalancing School
Complaints procedure: the complaints procedure used by the Rebalancing School in the context of the Activities;
Activity: the activities provided by the Rebalancing School (inspiration year, 2nd and 3rd year, workshops, retreats, development days, masterclasses, zoominars, open days, open afternoons and festivals)
Agreement: a study agreement between the Rebalancing School and a Participant in the context of the inspiration year, the 2nd and the 3rd year of the Rebalancing School.
Confirmation: a confirmation that a Participant receives in the context of following an Activity.
Program: the program of an Activity.
Rebalancing School: Stichting Opleiding Rebalancing in Arnhem (Chamber of Commerce number 41051017) trading under the name Rebalancing School voor Lichaamswerk en Bewustzijn (for Bodywork and Consciousness).
Website: the website of the Rebalancing School (www.rebalancing.nl).
Cancellation Conditions: the Cancellation Conditions of the Rebalancing School. The Cancellation Conditions are part of these General Terms and Conditions.
Article 2: Scope and changes
These General Terms and Conditions apply to every Agreement and Confirmation of the Rebalancing School.
The Rebalancing School has the right to change these General Terms and Conditions at any time. The amended General Terms and Conditions will be published on the Website before the effective date of the amendment and will apply from the date stated in the publication. The amended General Terms and Conditions apply to all new Agreements and Confirmations and to all current and current Agreements, insofar as they are executed after the publication of the amendment.
Article 3: Cancellation of Training or participation in the Training
The Rebalancing School has the option to cancel an Activity with insufficient Participants, or to merge groups, if necessary and possible.
The Rebalancing School has the option of organizing or executing an Activity differently in the event of force majeure and/or as a result of government regulations (for example in connection with an epidemic).
The Rebalancing School may refuse or terminate the participation of a Participant prior to or during an Activity, stating reasons, if, in the opinion of the Rebalancing School, the Participant is not (yet) able to, for whatever reasons, participate or continue to participate in the Activity. If the Rebalancing School is forced to refuse (further) participation in an Activity, because (at the discretion of the teachers involved in the Activity) it is no longer justified to allow the Participant to participate in the Activity (for example, because the Participant has a negative influence on the well-being of himself, other participants and/or teachers or the progress of the Activity). The Rebalancing School decides in consultation with the teachers involved in the Activity. See the Cancellation Conditions for the financial settlement of the points mentioned in this article.
Article 4: Payment
The down payment for the Inspiration Year is € 800, to be paid upon registration. No deposit is required for the other activities of the Rebalancing School. Unless otherwise provided in the Agreement or Confirmation, payments to the Rebalancing School are due within 14 days of the date of the relevant invoice. Reference is made to the Agreement for the complete payment terms and conditions relating to the inspiration year and the Vocational Training.In case of non-compliance with any payment obligation, the Participant is excluded from following or continuing the Activity; this does not affect the fact that the agreed payment obligations are maintained for the Participant. If a payment arrangement is agreed with the Participant or if an employer of the Participant pays the costs, the Rebalancing School will charge an amount of € 50 for administration costs.
Article 5: Intake
Prior to the start of the inspiration year of the Rebalancing School, an intake interview is held with a potential Participant.
Article 6: Confidentiality
The Rebalancing School guarantees to the Participant that all information provided by the Participant will be treated with the utmost discretion and strict confidentiality by the teachers of the Rebalancing School. Such information is not shared by the teachers with anyone other than within the Rebalancing School teaching team. Every teacher of the Rebalancing School signs for confidentiality in this regard.

Article 7: Term of the Agreement
An Agreement is entered into for the duration of one academic year and ends automatically after that.
Article 8: Reflection period
After signing an Agreement and after receipt of a Confirmation, a Participant has a reflection period of 14 days. In this context, point 5 of the Cancellation Condition applies.
Article 9: Insurance
In the context of the Activity, the Rebalancing School has taken out liability insurance with a maximum cover of € 1,500,000 per year.
Article 10: Complaints procedure
The Complaints Procedure is published on the Website. The Complaints Procedure is revised every 5 years. The latest version of the Complaints Procedure always applies to an Agreement/Confirmation.
Article 11: Intellectual property
The copyright and intellectual property of the study and teaching material produced by the Rebalancing School and made available to a Participant rests with the Rebalancing School and the Participant has no rights in this respect. The material may only be used for personal study purposes and may not be duplicated, disposed of or passed on.The use of the name “Rebalancer” is reserved for those who are certified Rebalancers (as indicated by the Rebalancing School). The Participant is aware of this and will not call himself or herself a “Rebalancer” or indicate that he or she will give Rebalancing sessions, as long as this has not been approved in writing by the Rebalancing School by means of a diploma. During the term of an Agreement or after termination of an Agreement and the receipt of a certificate for this, the Participant may indicate that he performs “body work using Rebalancing techniques”.
Article 12: The Program and teachers/team
The Program of the Activity is compiled by the Rebalancing School and may be changed by the Rebalancing School during the term of the Activity. The same goes for the location of the Activity. The Rebalancing School has the right to replace a teacher scheduled for an Activity, should this be necessary due to circumstances. In principle, the team remains the same during one year of the Activity, but the composition of the team can be changed by the Rebalancing School if necessary.
Article 13: Hiring third parties
The Rebalancing School is allowed to hire third parties for the performance of an Activity.
Article 14: Continuing Vocational training
A certified Rebalancer is required to attend continuing vocational training. The applicable rules and procedures (and the offer related to in-service training) can be found on the Website. If no further training is followed, the relevant Rebalancer cannot be listed on the Website.
Article 15: Competent court
All disputes arising from or in connection with an Agreement will in the first instance be submitted to the competent court in Arnhem.
